They must apply for the OWP from within Canada.<\/span><\/p>\n<p><span style=\"color: #000000;\">If your partner obtains an OWP, they will be legally authorized to work for most employers, in most industries in Canada.<\/span><\/p>\n<p><span style=\"color: #000000;\">For more information on the sponsorship process, read our previous articles on<a style=\"color: #000000;\" href=\"https:\/\/www.cicnews.com\/2024\/12\/are-you-eligible-to-sponsor-your-spouse-or-partner-for-canadian-immigration-1249302.html\"><strong>\u00a0assessing your eligibility<\/strong><\/a><strong>,<\/strong> and a\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.cicnews.com\/2024\/12\/step-by-step-sponsoring-your-spouse-or-partner-for-canadian-pr-1249468.html\"><strong>step-by-step breakdown of the PR application procedure<\/strong><\/a><strong>.<\/strong><\/span><\/p>\n<h2><span style=\"color: #000000;\">Who can apply to receive an OWP during the sponsorship process?<\/span><\/h2>\n<p><span style=\"color: #000000;\">Both the Spouse or Common-Law Partner in Canada Class (<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/inland-spousal-common-law-partner-sponsorship.html\"><strong>Inland<\/strong><\/a><strong>)<\/strong> and Family Class (<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/outland-spousal-common-law-partner-sponsorship.html\"><strong>Outland<\/strong><\/a>) sponsorship applications give the sponsored person the ability to apply for an\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/canadian-immigration-open-work-permits.html\"><strong>Open Work Permit<\/strong><\/a>\u00a0(OWP) if they are in Canada.<\/span><\/p>\n<p><span style=\"color: #000000;\">To be eligible to receive an OWP, your loved one must be:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">In a genuine relationship with the sponsor;<\/span><\/li>\n<li><span style=\"color: #000000;\">Included in an application for\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/canadian-immigration-residency-obligations.html\"><strong>PR<\/strong><\/a><strong>,<\/strong> and have received an Acknowledgment of Receipt (AOR) for their PR application from\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/ircc.html\"><strong>Immigration Refugees and Citizenship Canada<\/strong><\/a>(IRCC), confirming that IRCC has received and is processing the application; and<\/span><\/li>\n<li><span style=\"color: #000000;\">Living in Canada with the sponsor.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Individuals who are being sponsored for PR cannot apply for an OWP under this policy if<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Their PR application has been refused, withdrawn, or returned; or<\/span><\/li>\n<li><span style=\"color: #000000;\">They plan to apply for a\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/working-in-canada.html\"><strong>work permit<\/strong><\/a>at a port of entry.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">This process is different depending on whether the sponsored person already has valid temporary resident status in Canada or not:<\/span><\/p>\n<table width=\"661\">\n<thead>\n<tr>\n<td><span style=\"color: #000000;\">Spouse or partner\u2019s temporary status<\/span><\/td>\n<td><span style=\"color: #000000;\">Procedure<\/span><\/td>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td><span style=\"color: #000000;\">The spouse or partner has valid temporary status (<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/working-in-canada.html\"><strong>Work permit<\/strong><\/a><strong>,\u00a0<\/strong><a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/canadian-temporary-study-visa.html\"><strong>study permit<\/strong><\/a>, or\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/canadian-temporary-resident-visa-visitor.html\"><strong>visitor visa\/electronic travel authorization\u00a0<\/strong><\/a>(eTA))<\/span><\/td>\n<td><span style=\"color: #000000;\">Spouses or partners with valid temporary resident status can apply for an OWP through an IRCC secure account, once they receive an Acknowledgment of Receipt (AOR) from IRCC regarding their PR sponsorship application.<\/span><\/p>\n<p><span style=\"color: #000000;\">In special circumstances, IRCC may allow the sponsored person to apply for a work permit without an AOR if:<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; Their temporary resident status is set to expire in two weeks or less; and<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; They have already submitted their application to be sponsored for PR.<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"color: #000000;\">Spouse does not currently have temporary status in Canada<\/span><\/td>\n<td><span style=\"color: #000000;\">If the spouse or partner being sponsored does not currently have temporary status, they must wait until they&#8217;ve received an approval in principle letter prior to applying for an OWP.<\/span><\/p>\n<p><span style=\"color: #000000;\">In addition, the sponsored person cannot apply for an OWP under any other public policy or pilot program.<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #000000;\">If you have applied to sponsor your spouse or partner through the Spouse or Common-Law Partner in Canada Class (Inland sponsorship) and have submitted an application for an OWP, the OWP application will typically be processed within four months.<\/span><\/p>\n<p><span style=\"color: #000000;\">If you have submitted your application for sponsorship and have received an AOR from IRCC, your spouse or partner may be eligible for faster processing of their\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/canadian-temporary-resident-visa-visitor.html\"><strong>visitor visa<\/strong><\/a><strong>.<\/strong> As long as your loved one has submitted their application and received an AOR from IRCC, your spouse or partner can receive expedited processing on their visitor visa automatically.<\/span><\/p>\n<p><span style=\"color: #000000;\">Applications that require more information (for example, child custody documents) may take longer for the immigration department to process.<\/span><\/p>\n<p><span style=\"color: #000000;\">Once the sponsored person has gained temporary resident status, they may be eligible to apply for an OWP after having arrived in Canada.<\/span><\/p>\n<h2><span style=\"color: #000000;\">How to apply for an OWP for your loved one<\/span><\/h2>\n<p><span style=\"color: #000000;\">Once an application to sponsor your loved one for PR has been submitted, and your loved one is in Canada, they will need to sign in or create an IRCC secure account to apply for an OWP online (this is different from the PR portal account used to submit the application for PR initially).<\/span><\/p>\n<p><span style=\"color: #000000;\">Once signed into a secure account, your loved one will need to answer questions about their current situation and what kind of work permit they want to apply for, to receive a personalized document checklist. This checklist should have all the documents needed for the OWP application.<\/span><\/p>\n<p><span style=\"color: #000000;\">If you are\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/using-immigration-representative.html\"><strong>using an immigration representative<\/strong><\/a>, they can submit a work permit application for your loved one through the Authorized Paid Representative Portal.<\/span><\/p>\n<h2><span style=\"color: #000000;\">A note on filling out the \u201cDetails of intended work in Canada section\u201d<\/span><\/h2>\n<p><span style=\"color: #000000;\">IRCC advises that spouses and partners who apply for an OWP during the sponsorship process should answer the following questions in the \u201cDetails of intended work\u201d section of the OWP application accordingly:<\/span><\/p>\n<table width=\"661\">\n<thead>\n<tr>\n<td><span style=\"color: #000000;\">Prompt<\/span><\/td>\n<td><span style=\"color: #000000;\">Required response for sponsored applicants<\/span><\/td>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td><span style=\"color: #000000;\">Box 1: What type of work permit are you applying for?<\/span><\/td>\n<td><span style=\"color: #000000;\">Select \u201cOpen Work Permit.\u201d<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"color: #000000;\">Box 4: Job title and Brief description of duties<\/span><\/td>\n<td><span style=\"color: #000000;\">&#8211; Enter \u201cSCLPC FC OWP\u201d in the Job title box.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; Enter \u201cSCLPC FC applicant in Canada public policy\u201d in the Brief description of duties<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\">After submitting your application<\/span><\/h2>\n<p><span style=\"color: #000000;\">Your spouse will not be legally authorized to work in Canada until they have been issued their OWP\u2014unless they are authorized in some other way.<\/span><\/p>\n<p><span style=\"color: #000000;\">While your spouse or partner is waiting for their open work permit to be processed, they must maintain legal status as a temporary resident in Canada.<\/span><\/p>\n<p><span style=\"color: #000000;\">They must wait to begin work until after they have been successfully issued the OWP by IRCC.<\/span><\/p>\n<p><span style=\"color: #000000;\">If your spouse or partner already has a Canadian work permit, they may continue working as long as they\u00a0<a style=\"color: #000000;\" href=\"https:\/\/www.canadavisa.com\/implied-status-in-canada.html\">maintained their status<\/a>\u00a0by applying for an OWP before the expiry of their current work permit.<\/span><\/p>\n<p><span style=\"color: #000000;\">If their application for an OWP is successful, IRCC will issue a confirmation online, and the work permit by mail.
